3. 房产的法律转让(产权让与)将是下个一阶段。你会需要一名律师或一名有注册资格的产权让与人员来处理此阶段事务。费用可以双方协商,弄清楚增值税和(或)有关支出是否已包含在最初的报价中。产权让与是一个买方律师和卖方律师互相交换备忘录的过程。一份‘草拟合同’将由卖方律师写就,包含价格,以及卖家的房契信息等等。
你的律师将会检查并与卖方的律师协商,以你的名义进行的研究,质询和勘查将包括一个本地主权调查*,一份土地注册调查*。其他质询会检查例如矿产权,水淹和污染等。这部份产权让与过程会用去两周到一个月的时间不等。
4. 一旦你的律师和你同意,你需要在合同上签字。这将是对双方的法律的约束,以保障买卖顺利进行。基于此点,买方需要交纳10%的无返还保证金。
5. 准备就绪一份转让合同,阐明契约的转让并由双方签字。双方确认完成交易日期,与土地注册办公室的全面接触将被展开:支付印花税和其他有关注册费用。支付完成后,买方拿到房契,整个过程就此完成。 […]
